As a logo designer, this worries me!

Wow--what are the chances that an image of a seagull could get you a lawsuit from a megabrand like Hollister? Design is getting as scary as medical malpractice!

I guess unless you can afford lawyers to check everything in advance (what startup can afford a lawyer for something like this?) then you have to just go for it and use your new logo. There's an element of common sense, of course, but I agree--this seagull story is ridiculous and scary. best of luck, everybody.

I personally believe that most of the big shot companies use ridiculous strategies to try to create a monopoly to benefit themselves. Today, it is hard to come up with an original name or design that someone will not try to claim as theirs. Soon, we all will be sued for the names that we got at birth.

Hello, would like to know exactly what proof is needed re that you are using name in commerce so you can trademark it? Does getting business registered with the name you want to trademark a good cheaper first step? And, can I just trademark in state for $87? or so? and do USA or world later? Tks much!

Your work can easily be original as your own - but you should at least try to search if someone has it.

About that seagull thing, I don't know where to stand. Seagulls can’t be used on any shirts anymore if Hollister wins the case. They own their logo, but if the drawings do not really resemble theirs, I think there is nothing wrong.
